General Conditions.
These General Sales Conditions regulate the contractual relationship of sale between **MWI: MAY WORLDWIDE INTERNATIONAL, LIMITED LIABILITY COMPANY** (hereinafter, "the Seller") and the customer (hereinafter, "the Buyer") through the website: www.maywi.es
The placing of an order by the Buyer implies the unconditional acceptance of these terms and conditions, which the Buyer acknowledges having read. The purchase cannot be completed until the Buyer has read and accepted these terms. It is warned that the terms may be modified, so they should be read each time a transaction is to be made.
The use of the items to be advertised on other websites or marketplaces not expressly authorized by MWI is expressly prohibited.

Relevant information about the Seller's condition: In accordance with current regulations, the Buyer is informed that the seller acts within the framework of their professional or business activity. Therefore, this transaction is subject to consumer and user protection regulations, including the right of withdrawal and legal guarantees of conformity, as detailed in these terms, which are drafted in compliance with Article 97 bis of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter, TRLCU).
2. Object of the Contract.
The object of the contract is the sale of the products offered by the Seller on their website: www.maywi.es The main characteristics of each product are detailed in their respective descriptive sheet, in accordance with the provisions of Article 60 TRLCU, Pre-contractual Information.
3. Purchase Process.
Purchases can be made as a guest. To expedite purchases for returning customers, there is the option to register as a user on the website. To do this, you must first register as a user or through the method(s) offered as an option by the website.
Step 1. User Registration.
To register as a user on the website, it is essential to be over eighteen years old and to provide all the required information identified as mandatory through the registration form. The registered user assumes that their user account is personal and non-transferable. Every registered user will have an access password, which will also be personal, non-transferable, have a limited temporal validity, and must meet minimum length and security requirements. The user can modify or recover this password at any time, following the procedure provided on the website. It is the user's obligation to immediately notify MWI of any event that allows the misuse of identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed with their immediate cancellation. Until such events are communicated, MWI will be exempt from any responsibility that may arise from the misuse of identifiers or passwords by unauthorized third parties. In the case of operating as a guest, step 1 will be skipped.
Step 2. Product selection, shopping cart validation, and order placement and payment.
The Buyer will select the product(s) they wish to purchase and add them to their shopping cart on the platform. Once the selection is complete, the Buyer will proceed to process the order through the interface. The Buyer must provide the shipping and billing information requested by the website and choose a payment method. Before payment and order confirmation, a summary of the order (products, total price including taxes and shipping costs, delivery information, and payment method) will be presented to the Buyer for review and acceptance. After acceptance, the system will automatically redirect them to the online payment platform (TPV) of the corresponding banking entities. To complete the purchase, once the relevant banking information is entered, they must click the "PAY" button.
The Seller, once they have received the payment through the online payment platforms (TPV or similar), will send a confirmation of the receipt of the order through the platform's messaging system or to the email provided by the Buyer. This process complies with the pre-contractual obligations established in Article 27 TRLCU.
4. Price and Payment Methods.
The price of each product is the one listed in its descriptive sheet at the time of processing the order. All prices are shown in Euros (€) and **include** the **Value Added Tax** (VAT) (IGIC in the case of the Canary Islands) as well as the **shipping costs** (if the shipment is within the Spanish mainland territory).
For orders destined for the Balearic Islands and Canary Islands and outside of Spanish territory, **shipping costs are not included** in the product price. In this case, they will be itemized during the purchasing process before final confirmation, as required by Article 20 TRLCU. In this case, the amount of shipping costs will vary depending on the customer's delivery address, as well as the weight and volume of the items being ordered. The amount of these shipping costs is indicated in the Shipping Costs tab, located on the page of each product contained in the cart. Shipping costs are confirmed when validating the order and are charged at the end of the order, adding to the price of the items being ordered.
The **payment** will be made exclusively through the secure payment gateway provided on the website. All payment methods offered by MWI are subject to checks and authorizations by the issuing entities of the payment method (card issuers and/or payment account issuers), but if such entity does not authorize the payment, the purchase procedure initiated cannot continue, and the order will be automatically canceled, and it will be understood that the sale of the requested Product or Products has not been completed. On the MWI website, all transactions are carried out through secure payment systems. The confidential payment data is transmitted directly and encrypted (SSL) to the banking entity. In the case of making the payment by credit card, the customer's order will not be validated until the charge is made to the account under the authorization of the competent payment centers. If the payment is not authorized, the customer's order cannot be accepted. Online payment by credit card is made through the website's security systems, which allow the encryption of the customer's banking data during its transmission over the network.
In case of any unauthorized charge, you must report it through the channels established on the website, via email: atencion.clientes@mwi-online.online, for any unauthorized or fraudulent charge so that they can also contact the WEB and collaborate in resolving the improper charge.
The website may include the option for **deferred payment**. This service will be provided by an entity independent of MWI, so you must read and accept the conditions that it expressly requires on the platform when choosing the deferred payment option.
5. Shipping and Delivery.
**Delivery times:** The estimated delivery time will be indicated during the purchasing process and will not exceed [15] calendar days from the order confirmation, unless otherwise agreed. **Shipping costs:** The shipping costs will be those specified during the purchasing process. **Delivery location:** Delivery will be made to the address provided by the Buyer. The Seller is not responsible for delivery errors caused by an incorrect or incomplete address. Delivery to P.O. boxes, private or public places where entry is not possible without express authorization, closed places such as squares, stations, airports, etc., will not be possible.
In the event that delivery to the customer cannot be made due to reasons attributable to the customer (absence at the previously scheduled appointment, material impossibility of introducing the product at the shipping address, etc.) and provided that the customer does not agree to pay for the second delivery costs, it will be considered that the customer has withdrawn from the contract, and the provisions regarding the assumption of shipping costs by the parties will apply.
The carrier will contact the customer via email, SMS, or phone to arrange a delivery date. The customer is solely responsible for verifying that the dimensions of the requested product are compatible with the access to their home or delivery address, paying particular attention to doors, stairs, ceilings, hallways, landings, etc. All measurements of MWI products are actual measurements that do not take into account transport packaging. All additional costs related to the rental of lifts, storage, or the customer's absence (breaching the commitment made when scheduling the appointment) and the risks of damage arising from these issues will be borne by the customer. In the event that delivery cannot be made on the scheduled day due to access or passage difficulties not previously indicated by the customer, insufficient space for product assembly, or the customer's absence on the agreed delivery day with the carrier, MWI will re-invoice the shipping costs. In this case, MWI operates through the WEB and distributes its products through deliveries for the Spanish territory, which includes the Iberian Peninsula and the Balearic Islands (hereinafter referred to as the "Territory"). The customer agrees to be at the delivery location on the agreed day for delivery with the carrier and to verify the conformity of the order and each of the products at the time of receipt of the goods.
In case of a claim regarding possible defects or signs of deterioration of the products (breakage, missing product in relation to the delivery order, damaged packaging, broken products, etc.), we advise the customer to indicate the appropriate observations on the delivery note (this will facilitate the resolution of the incident) and also to report an incident in their customer space on the website or through: atencion.clientes@mwi-online.online within a maximum period of 48 hours. We recommend reporting any damage suffered as soon as possible. From the receipt of the product, it will be understood that the product, once delivered, becomes the property of the customer. Except in the case of hidden defects, no claims or reservations will be accepted after the customer has received the products if they have not followed the procedure detailed above. In case of delay in delivery, once 10 working days have passed since the delivery deadline of the order expired, without such delay being due to a case of force majeure, the customer has the right to cancel the contract. This contract will be considered canceled from the moment MWI receives the communication in which the customer informs of this decision. The customer has a period of 14 days from the indicated delivery date to exercise this right, in which case the amounts paid for the order will be refunded to the customer.
In special promotions such as sales and/or free shipping, there may be delays in the dispatch of orders. We will not be responsible for any non-compliance or delay in fulfilling any of the obligations we assume under a contract, the cause of which is due to events that are beyond our reasonable control ("force majeure"). It will be understood that our obligations arising from the contracts will be suspended during the period in which the force majeure continues, and we will have an extension of the time to fulfill such obligations for a period equal to the duration of the force majeure. We will make all reasonable efforts to end the force majeure or to find a solution that allows us to fulfill our obligations under the contract despite the force majeure. Unpacking and assembly are also not included.
6. Right of Withdrawal.
The Buyer, in their capacity as a consumer, has a period of **fourteen (14) calendar days** to withdraw from the contract without the need for justification (art. 102 TRLCU). **Period:** The period will begin to count from the day the order is delivered. This is considered the moment of **acquisition of material possession**. **Exercise:** To exercise this right, the Buyer must notify their decision to withdraw from the contract through an unequivocal declaration via atencion.clientes@mwi-online.online **Consequences:** The Seller will refund all payments received from the Buyer once they have received and reviewed the goods subject to the transaction and the Buyer has paid the return costs (direct return cost). The return of additional shipping costs is excluded if the Buyer selected a delivery method different from the least expensive or standard one, as well as anything not included in the standard or ordinary shipment, such as home delivery or assembly.

* The return cost with specialized pickup (home collection) has a surcharge of €40.00/m³. We will collect the products from the location where they are deposited. Please remember that this service does not include disassembly or packaging.
7.- Cancellation.
If you wish to cancel the order or part of the items, you must do so as soon as possible by contacting: atencion.clientes@mwi-online.online with the subject “CANCELLATION of order no. …”. If the product has not left our facilities or logistics center, or has not been packaged (in the case of shipping with multiple products), the full amount paid will be refunded. If the product has already been shipped, the return cost specified in the previous clause (returns) will be retained.
8. Product availability.
MWI will accept any order as long as stock is available, regardless of the delivery time. Regarding flash sales, customers can only order products that are on sale during the duration of the flash sale, which is indicated in real-time on the MWI site and within the limit of available stock. Once the flash sale period for a product has ended and/or if the product is not available, it will no longer be for sale. To properly inform the customer, the lack of availability of a product will be indicated on the website. If a problem with the stock of the desired products is detected after the confirmation of an order, MWI will inform the customer of the unavailability of the product and will ask if they would like to make a partial delivery of their order and wait for new stock of the out-of-stock product, exchange the out-of-stock product for a substitute product, or if they wish to cancel the product or the entire order. In the latter case, in order to satisfy its customers and to maintain calm and satisfactory business relationships while complying with legally established criteria, MWI will refund the amounts that have already been paid (including any shipping costs that have been paid) within fourteen (14) calendar days from the time the cancellation of the order has been opted for. This refund will be processed using the same payment method that was used by the customer.
9. Product features.
The products presented on MWI are sold within the limits of available goods and subject to availability from MWI's suppliers. MWI publishes the basic characteristics of the products with the utmost rigor, mainly thanks to the technical descriptions from partners and suppliers, as well as photographs and/or videos of the products, all depending on the technique and respecting the best market standards. The photographs illustrating the products may have slight differences from the original product due to possible improvements or developments that have been made to the product. Nevertheless, we cannot guarantee the exact representation of our products on the WEB, particularly as a result of differences in color rendering by internet browsing software and/or display monitors. MWI cannot be held responsible for the inaccuracy of the photographs displayed on the WEB due to color differences caused by internet browsing software and/or display monitors. Certain products (handcrafted products; products whose technology is evolving, etc.) may, to some extent, differ from the product described and represented on the WEB. We cannot guarantee the homogeneity of production; therefore, we cannot guarantee that the delivered product will be exactly the same as that represented on the WEB. These differences, as long as they do not refer to the essential characteristics of the products and do not affect their quality, cannot justify an order cancellation or a refusal of delivery, without prejudice to the consumer's right of withdrawal as provided in articles 101, 68, and related articles of the Consumer and User Protection Law.
10. Warranties and Product Compliance.
The Seller will be liable to the Buyer for any lack of conformity that exists at the time of delivery of the product, under the terms and deadlines established in current legislation. (117 TRLCU). The Buyer may demand the remedy of the lack of conformity (repair or replacement), a reduction in price, or the termination of the contract. Communication should be made through; atencion.clientes@mwi-online.online The customer receives a warranty against any consequences of damages or hidden defects that may be contained in the sold items, provided that these are reported before the 3 years have elapsed since their delivery, except for those products that indicate another extended period, or if the buyer is not considered a “consumer and user,” in which case the warranty will be SIX months. After this period, no warranty will apply. Damages or defects will be verified by the after-sales service.
The warranty of any purchased product will be invalidated for damages caused by:
- Transport, accidents, improper use, and other damages not due to the normal use of the product by the customer after the delivery of the goods. This warranty only covers damages caused by transport before the receipt of the material.
The following will also not be considered under warranty:
- Stains, bodily fluids, and/or animals.
- Burns, cuts, abrasions, the appearance of "peeling" (bobbles in the fabric), wrinkles, marks, scratches, or other damages caused by animals, by treatment with discouraged products, direct contact with other fabrics and/or materials, or by improper use of the product, including accumulated dirt.
- Use or contact with chemical products (acids, solvents, dyes, paint, ammonia, lacquers, or other hairdressing products...), treatment with cleaning products not indicated for the specific upholstery of the guaranteed product. In the case of fabric upholstery, pay special attention to the composition and cleaning instructions for each of them, reflected with labels on the product itself.
- Color deterioration due to exposure of the product to sunlight or other heat sources. A minimum distance of 60 cm is recommended, depending on the power of the source, and in no case should the product be exposed directly to sunlight.
- Moisture stains are not covered by the Warranty if this fact is not communicated within 2 days after the delivery of the sofa/product.
- Breakage of slats in bed bases is not covered by the Warranty if this fact is not communicated within 2 days after the delivery of the product.
- suffer natural wear due to use or due to inappropriate use for the characteristics of the item.
Specific exceptions for Leather and Sofas:
- Leather is a natural product exposed to changes in its color, texture, and elasticity. The presence of wrinkles, marks, or possible lack of uniformity in color are natural characteristics of leather (which denote its origin and the difference from artificial products), therefore, they cannot be considered manufacturing defects and are excluded from this warranty.
- In white leather sofas, their shade will never be pure white, as that color is only achieved through chemical products, which are harmful to the upholstery; therefore, you may perceive a slight variation in shade, approaching off-white, which will not be a reason for return.
- In white, off-white, or very light beige leather sofas, you should keep in mind that, over the years, their use and exposure to artificial light sources or sunlight may present a slightly yellow tone. This is a natural behavior of the leather and will not be considered a defect.
- The loss of volume of polyurethane foam, layers, acrylic fibers, feathers, and other filling products in cushions (seats, backs, arms, and lumbar supports) is a direct consequence of their use; therefore, it should not be confused with loss of elasticity or accelerated wear due to manufacturing processes or materials used.
WILL NOT BE SUBJECT TO WARRANTY AND WILL NOT BE A REASON FOR RETURN:
- In sofa beds, the deformation of the mattresses due to use.
- The sound produced by the metal guides that make up the sliding systems of the seats.
- The non-homogeneity in the fillings of budget sofas, which may be composed of foam flakes. This filling can cause wrinkles on the surface of the sofa, which do not affect the product's performance.
**NOTE:** The measurements listed on each product sheet are approximate and may vary due to different manufacturing causes. They are always calculated without compressing any element and from the outermost parts of the sofa. In case of an incident or problem with the product, you should keep in mind that the merchandise will be collected in the same manner it was delivered. Thus, for example, if you received a sofa with curbside delivery, the collection of that merchandise will also be done curbside. In any case, the warranty start date is the one indicated on the purchase invoice. Additionally, some parts of the products may undergo changes in softness or feel due to use, which is a normal condition for these items.
“OUTLET” or “Second Hand” Items
Products classified as **“OUTLET”**, **“refurbished”**, or **"second hand"** will be considered a special category and can never be regarded as new, containing specific online sales conditions for second-hand items (120.1 paragraph 2 TRLCU), applying the provisions of current regulations for second-hand items, with a **1-year warranty**. This type of product goes through the necessary processes to be adapted and suitable for sale. These items will be purchased with variable discounts, as they may show defects such as stains, scuffs, unravelling, and/or others, which will not be applicable to the product's purchase warranty.
MWI offers its customers a post-sale service to address any issues that the product may present during the three years of legal warranty for manufacturing defects. To do this, the customer must open the issue from their customer space and provide the necessary photographs and/or video for the handling of said issue. **Without photographs, issues will not be addressed.** **Technical support service:** The technical support service will be provided to the customer upon their contact through the email address atencion.clientes@mwi-online.online, and the communication made by the customer must include sufficient information (photos and videos) to identify the sales transaction, the purchased item, and the nature of the reported issue. The technical service may request all evidence it deems necessary for the resolution of the issues and provide the most appropriate response with the available information.
11. Responsibility.
The Seller is solely responsible for the sale of the products and for managing any claims or issues related to the sales contract.
12. Severability of clauses.
The fact that any clause of the general terms and conditions of sale is declared null, unenforceable, expired, illegal, or inapplicable due to a law, regulation, or after a final judgment from a competent jurisdiction, shall not call into question the validity, legality, and applicability of the other stipulations of these general terms and conditions of sale, and shall not exempt the customer from fulfilling their contractual obligations. The part of the contract affected by the nullity will be integrated in accordance with the provisions of Article 1,258 of the Civil Code and the principle of objective good faith. For these purposes, the Judge who declares the nullity of such clauses will integrate the contract and will have moderating powers regarding the rights and obligations of the parties, when the contract remains in effect, and regarding the consequences of its ineffectiveness in the event of appreciable harm to the consumer and user. Only when the remaining clauses determine an inequitable situation in the position of the parties that cannot be remedied may it be understood, and the Judge may declare the ineffectiveness of the contract.
13.- Modification of the general terms and conditions of sale.
These conditions govern the order placed. However, they may be modified and updated, so it is recommended to read them in full prior to acceptance for subsequent orders, even if they are not excessively spaced in time.
14.- Protection of Personal Data.
The personal data of the Buyer will be processed by the Seller solely for the purpose of managing the order, delivery, and invoicing. Such processing will be carried out in accordance with the privacy policy of WEB and the applicable regulations on data protection.
15. Applicable Legislation and Jurisdiction.
This contract will be governed and interpreted in accordance with Spanish law. For the resolution of any disputes that may arise, the parties submit to the Courts and Tribunals of the Buyer's domicile, if the Buyer is a consumer.
